Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of moherntitan.com (the “Site”), operated by MoHern Titan Construction Inc. (“MoHern Titan Co,” “we,” “us,” or “our”), a licensed California general building contractor based in Glendale, California. By using the Site, submitting a form, or using our Project Cost Estimator, you agree to these Terms. If you do not agree, please do not use the Site.

1. Contractor License

MoHern Titan Construction Inc. holds California Contractors State License Board (CSLB) license #1128107, Classification B – General Building Contractor. You can verify our license status at any time on the CSLB website.

Contractors are required by law to be licensed and regulated by the Contractors State License Board, which has jurisdiction to investigate complaints against contractors if a complaint regarding a patent act or omission is filed within four years of the date of the alleged violation. A complaint regarding a latent act or omission pertaining to structural defects must be filed within 10 years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors State License Board, P.O. Box 26000, Sacramento, CA 95826, 1-800-321-CSLB (2752), www.cslb.ca.gov.

2. Information on This Site

The service pages, blog articles, project photos and guides on this Site (including content about ADUs, zoning, permits, architecture, interior design and building costs) are general information only. They are not architectural, engineering, legal, tax or financial advice for your property. Building codes, zoning rules and permit requirements change and vary by city, so please confirm requirements for your property with us during a consultation or with your local building department.

Photos and renderings show the type of work we do. Your finished project will depend on your design, site conditions, approvals and selections.

3. Estimates and the Project Cost Estimator

The Project Cost Estimator and any prices, price ranges or cost-per-square-foot figures on this Site are budgeting guides only. They are not a bid, an offer, a contract, or a guarantee of price. Actual costs depend on final design, site and soil conditions, permit and utility fees, material pricing and your selections. Final pricing is provided only after a site visit and project review, and is binding only in a written contract signed by you and us.

4. Construction Contracts

Using this Site, submitting a form, or booking a consultation does not create a contract for construction work. Every project is performed under a separate written contract that complies with the California Contractors State License Law, including Business and Professions Code section 7159 for home improvement contracts where it applies. That contract governs the scope of work, price, payment schedule, change orders, warranties and your cancellation rights. If your contract and these Terms conflict, your contract controls.

For your protection under California law:

  • The down payment on a home improvement contract may not exceed $1,000 or 10% of the contract price, whichever is less.
  • Progress payments may not exceed the value of the work performed or materials delivered.
  • You may have the right to cancel a home improvement contract within three business days after signing it, or within five business days if you are 65 or older. Your contract will explain any cancellation right that applies.
  • All change orders must be in writing and signed by you and us.

5. Free Consultations and Communications

Consultations and estimates are free and carry no obligation. When you give us your name, phone number or email address through the Site, you agree that we may contact you by phone, email or text message about your inquiry or project. We will not send you marketing messages without your consent, and you can ask us to stop contacting you at any time. Every newsletter email includes a way to unsubscribe.

6. Disaster and Fire Rebuild Pricing

We help Los Angeles–area homeowners rebuild after wildfires and other disasters. During a declared state of emergency, we comply with California Penal Code section 396, which limits price increases on goods and services, including repair and reconstruction services.

7. Intellectual Property

All content on this Site, including text, photos, graphics, logos, the Project Cost Estimator and the MoHern Titan name, belongs to MoHern Titan Construction Inc. or its licensors and is protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use. You may not copy, republish or distribute Site content for commercial purposes without our written permission.

8. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Submit false information or another person’s contact details through our forms.
  • Send spam, malware or automated submissions through our forms or estimator.
  • Scrape, copy or harvest Site content or data with automated tools.
  • Attempt to gain unauthorized access to the Site or interfere with its operation.

9. Third-Party Links and Services

The Site links to third-party websites and services, such as Google, Yelp, social media platforms and the CSLB. We do not control those sites and are not responsible for their content, policies or practices. Your use of them is governed by their own terms.

10. Reviews and Testimonials

Reviews and testimonials on the Site reflect the individual experiences of our clients. Every project is different, and results, timelines and costs vary.

11. Disclaimer

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties about the Site, including that it will be error-free, uninterrupted or free of viruses. This disclaimer applies to the Site only. It does not affect the warranties in your written construction contract or any warranty that California law requires and that cannot be waived.

12. Limitation of Liability

To the fullest extent permitted by law, MoHern Titan Construction Inc. is not liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Site or its content. Nothing in these Terms limits any liability that cannot be limited under California law, and these Terms do not limit our obligations under a signed construction contract.

13. Indemnification

You agree to indemnify and hold harmless MoHern Titan Construction Inc. and its officers and employees from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.

14. Privacy

Our Privacy Policy explains how we collect, use and protect your personal information. It is part of these Terms.

15. Accessibility

16. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute about these Terms or the Site will be resolved in the state or federal courts located in Los Angeles County, California. Nothing in this section takes away any right you have as a consumer under California law.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and change the effective date above. Your continued use of the Site after a change means you accept the updated Terms.

18. Severability

If any part of these Terms is found unenforceable, the rest remains in full effect.
