This Privacy Policy explains how MoHern Titan Construction Inc. (“MoHern Titan Co,” “we,” “us,” or “our”) collects, uses and shares personal information through moherntitan.com (the “Site”), and the choices you have. It is written to meet the California Online Privacy Protection Act (CalOPPA) and to describe the privacy rights available to California residents.

1. Information We Collect

Information you give us

  • Contact form: your name, email address, phone number and message.
  • Consultation form: your name, email address, phone number, preferred contact method, project type and project details.
  • Project Cost Estimator: your project details (such as project type, size, number of stories, bedrooms and bathrooms, finish level, add-ons and ZIP code), plus your name, phone number, email address, project timeline, preferred contact time and any notes you add when you request a consultation.
  • Newsletter sign-up: your email address.
  • Phone calls and emails: whatever you choose to share with us when you contact us directly.

Information collected automatically

When you visit the Site, we and our partners automatically collect information such as your IP address, browser and device type, the pages you view, the site that referred you, the date and time of your visit, approximate location based on your IP address, and how you interact with pages. This is collected using cookies, pixels and similar technologies, described in section 3.

2. How We Use Your Information

  • To respond to your questions and requests.
  • To prepare estimates, schedule consultations and site visits, and deliver our construction, remodeling, design and architecture services.
  • To send you our newsletter and promotions, if you signed up. You can unsubscribe at any time.
  • To understand how visitors use the Site and improve it.
  • To measure our advertising and show our ads to people who have visited the Site.
  • To protect the Site against spam, fraud and security threats.
  • To keep business records and comply with legal obligations, including California contractor licensing requirements.

3. Cookies, Analytics and Advertising

You can also opt out of interest-based advertising from many companies through the Digital Advertising Alliance and the Network Advertising Initiative, and you can block or delete cookies in your browser settings. Blocking cookies may affect how some parts of the Site work.

Do Not Track: Some browsers send a “Do Not Track” signal. Because there is no common industry standard for these signals, our Site does not currently respond to them. You can still opt out of analytics and advertising cookies using the options above, or contact us and we will help.

4. How We Share Your Information

  • Service providers that help us run our business, such as website hosting, email, analytics, customer relationship management and scheduling tools. They may use your information only to provide services to us.
  • Advertising partners, such as Meta, as described in section 3.
  • Project partners, when needed to carry out your project, such as architects, engineers, subcontractors, suppliers, and city or county building departments for permits.
  • Legal and safety reasons, when required by law, subpoena or a government or licensing agency, or to protect our rights, property or safety and that of others.
  • Business transfers, if our business is sold or merged, in which case your information would remain subject to this Policy.

We do not sell your personal information for money. We do not share your personal information with third parties for their own direct-marketing purposes.

5. Your California Privacy Rights

If you are a California resident, you can ask us to:

  • Know and access the personal information we have collected about you and how we use and share it.
  • Correct personal information that is inaccurate.
  • Delete personal information we hold about you, subject to legal exceptions such as records we are required to keep.
  • Opt out of the use of your information for targeted advertising (which California law may treat as “sharing”), as described in section 3.

We extend these choices to every visitor, and we will not discriminate against you for using them. Under California’s “Shine the Light” law (Civil Code section 1798.83), you may also ask whether we have disclosed your personal information to third parties for their direct-marketing purposes. We have not.

We will confirm your identity before acting on a request and will respond within 45 days. You may use an authorized agent to make a request on your behalf.

6. How Long We Keep Information

We keep inquiry and estimate information for as long as we need it to respond to you and follow up on your project. Client and project records are kept as long as the law requires; for example, California requires contractors to keep project records for at least five years after a project is completed. Newsletter email addresses are kept until you unsubscribe.

7. How We Protect Your Information

We use reasonable administrative, technical and physical safeguards, including an encrypted (HTTPS) connection, to protect your information. No website or method of storage is 100% secure, so we cannot guarantee absolute security.

8. Children's Privacy

The Site is intended for adults and is not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, please contact us and we will delete it.

9. Links to Other Websites

The Site links to other websites, such as Google, Yelp, social media platforms and the CSLB. Their privacy practices are governed by their own policies, not this one.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and change the effective date above. If we make a material change, we will also note it on our home page.
